Why Scott Riggs failed to qualify in certain races (Even he is an exempt in the Daytona 500)?

Hello again in a another question about the DNQ´s and provisionals why the #10 James Rocco car failed to qualify in Darlington, Sonoma, etc... in the 2007 season

The car fell outside of the top 35 exempt drivers in points. After the first 5 races, whether you are guaranteed a spot or not can change on a race by race basis.

say the top 35 points are this after 6 races

31st - 82 Generic Driver #1 Motorsports
32nd - 90 Team Jane Doe
33rd - 45 Enter Name Racing
34th - 10 Valvoline Evernham Motorsports
35th - 97 Lorem Ipsum Motors
----------------------------
36th - 23 Russ T. Razor Enterprises
37th - 01 Generic Driver #2 Sports Racing
38th - 26 Team Slick Quickmouth

In this scenario Scott Riggs would be guaranteed a spot regardless of speed.

NOW say Riggs has a terrible race, and his rivals have solid results and the points now look like this.

31st - 82 Generic Driver #1Motorsports
32nd - 90 Team Jane Doe
33rd - 23 Russ T. Razor Entrprises
34th - 45 Enter Name Racing
35th - 97 Lorem Ipsum Motors
----------------------------
36th - 10 Valvoline Evernham Motorsports
37th - 01 Generic Driver #2 Sports Racing
38th - 54 Cale Burnhard Motorsports

Now the #10 car is at risk of failing to qualify if is isn't one of the fastest 8 cars in time trials, or 7 if another car has a driver who has a past champions provisional available.
